Terms of Service

1. Acceptance of Terms

These Terms of Service are between you and Elementor Software PTY LTD (ACN pending), the company that owns and operates the InstantITP service ("the Service") at instantitp.com. By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Description of Service

InstantITP is an AI-powered tool that generates Inspection and Test Plan (ITP) documents in Excel format based on construction drawings and specifications you upload. The Service uses the Anthropic Claude API to analyse your documents and produce structured ITP content.

3. Eligibility

You must be at least 18 years old to use the Service. By using InstantITP you represent that you are of legal age and have the authority to enter into this agreement on behalf of yourself or your organisation.

4. Account Registration

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must provide accurate and complete information when registering.
• Notify us immediately at support@instantitp.com if you suspect unauthorised access to your account.

5. Payments and Refunds

• The current price for a single ITP generation is $10.00 USD.
• Payment is processed securely by Stripe. We do not store card details.
• Payment is charged at the time of checkout before generation begins.
• Refund policy: If the Service fails to generate and deliver your ITP due to a technical error on our part, we will provide a full refund. Refunds are not available for successfully generated ITPs that you consider unsatisfactory — the AI-generated content is inherently variable and you are responsible for reviewing it before use. To request a refund, email support@instantitp.com within 7 days of purchase.

6. Acceptable Use

You agree not to:

• Upload documents you do not have the right to share (e.g. confidential third-party documents without authorisation)
• Attempt to reverse-engineer, scrape, or extract our AI prompts or generation logic
• Use the Service for any unlawful purpose
• Abuse, harass, or attempt to gain unauthorised access to our systems
• Resell or white-label the Service without written permission

7. Intellectual Property

Your content: You retain ownership of all documents you upload. By uploading, you grant us a limited licence to process those documents solely for the purpose of generating your ITP.

Generated ITPs: The Excel ITP files generated for you are yours to use, modify, and distribute freely for your construction projects. You are responsible for their accuracy and suitability.

Our platform: The InstantITP software, design, branding, and AI prompt logic are the intellectual property of Elementor Software PTY LTD. Nothing in these terms grants you any rights to our platform beyond using the Service as intended.

8. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind. We do not warrant that:

• Generated ITPs are complete, accurate, or suitable for any particular project
• The Service will be uninterrupted or error-free
• The AI output will comply with all applicable Australian Standards or project specifications

Construction ITPs are professional documents that require expert review. InstantITP is a drafting aid, not a substitute for qualified engineering or construction management judgment.

9. Limitation of Liability

To the maximum extent permitted by Australian law, Elementor Software PTY LTD's total liability to you for any claim arising from use of the Service is limited to the amount you paid for the specific generation that gave rise to the claim.

We are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of profit, project delays, site incidents, regulatory penalties, or costs arising from reliance on an AI-generated ITP without appropriate expert review.

10. Indemnification

You agree to indemnify and hold harmless Elementor Software PTY LTD and its directors, employees, and contractors from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your use of generated ITPs on a construction project.

11. Termination

We reserve the right to suspend or terminate your account at our discretion for violation of these Terms. You may terminate your account at any time by emailing us. Upon termination, your data will be deleted in accordance with our Privacy Policy.

12. Changes to Terms

We may update these Terms from time to time. We will notify registered users of material changes by email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of Queensland, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Queensland.
